Changes to ownership

To assist you with your account, we’ve listed below many common situations that require changes to your account. Next to each situation is a listing of the usual documentation required in order to complete the change. Some variations in documentation may exist due to the laws of differing jurisdictions. With some exceptions, most of these documents must be recorded in the county where your interest is located. All change requests must be submitted in writing and cannot be taken over the phone.

Please be aware that federal law requires that owners provide their social security number or tax identification number. Failing to provide this information may cause you to become subject to non-refundable backup withholding.

Address Change Submit request in writing with your signature (link to form). (Does not require recording in the county where your interest is located)
Individual Name Changes Marriage Certificate, Divorce Decree restoring maiden name or other legal documentation of name change
Company Name Change Certificate of Name Change or Amended Certificate of Incorporation, including tax I.D
Company Name Change Due to Merger Certificate of Merger including tax I.D.
Appointment of Attorney-In-Fact Copy of Power of Attorney
Sale of Interest Conveyance instrument filed of record in the county or parish in which the property is located.
Ownership Change Due to Divorce Divorce Decree with Settlement Agreement and recorded conveyance instrument (if applicable)
Trust or Partnership Creation or Dissolution Trust or Partnership Agreement and recorded conveyance(s)
Changes in Trustee Instrument appointing Successor Trustee
Joint Tenancy with Death of One Tenant Certified Death Certificate of deceased Joint Tenant or Affidavit of Surviving Joint Tenant, filed of record in the county where the property is located
Death of Owner with a Will with Probate
  • Final Decree of Distribution or Judgment of Possession, recorded in the county where the property is located
  • Evidence debts and taxes have been paid, recorded in the county where the property is located
  • If probate was conducted in a different state than where the property is located, documentation of Ancillary Probate Proceedings in any other states where the property is located, recorded in the county where the real property is located
Death of Owner Without a Will
  • Judicial Determination of Heirship or Affidavit of Death and Heirship, recorded in the county where the real property is located
  • Evidence debts and taxes have been paid, recorded in the county where the property is located
Life Estate – Death of Life Tenant
  • Certified Death Certificate of deceased life tenant or Affidavit of Remaindermen, recorded in the county where the real property is located
  • Original instrument that created the life tenancy, recorded in the county where the property is located
  • Names and addresses of remaindermen
Pay to an Estate Letters Testamentary, certified Death Certificate, and Estate Tax I.D. (Does not require recording in the county where your interest is located)
Bankruptcy – Chapter 11 Plan of Reorganization and Order Confirming Plan of Reorganization (Does not require recording in the county where your interest is located)
Bankruptcy – Chapter 7 Order Naming Trustee of Bankruptcy Estate and recorded conveyance (where applicable) (Does not require recording in the county where your interest is located)
